No. FIN/ LOT-12/ 2002 (A): In exercise of the powers conferred by sub-section (1) of Section 12of the Lotteries (Regulation) Act 1998, (Central Act 17 of 1998), the Governor of Nagaland is pleased to notify the Lotteries (Regulation) Rules, 2010 framed by Government of India, Ministryof Home Affairs, to regulate the lotteries organized and conducted by the State Government:-

1.      Short title and commencement.

  • The serules may be called the Lotteries (Regulation) Rules,
  • They shall comeinto forceon the date of publication in the Official

2.      Definitions.

  • In these Rules,unless the contex to ther wise requires,
    • “Act”meansthe Lotteries(Regulation)Act,1998(CentralActNo.17of 1998);
    • “Central Computer Server” means a system of multiple computers at a central location under the direct control of the Organising State that accepts, processes, stores and validates the online lottery transactions or otherwise manages, monitors and controls the entire system of online lottery;
    • “Distributor or Selling Agent” means an individual or a firm or a body corporate or other legal entity under law so appointed by the Organising State through an agreement to market and sell lotteries on behalf of the Organising State;
    • “Draw” means a method by which the prize winning numbers aredrawn for each lottery or lottery scheme by operating the draw machine or any other mechanical method based on random technology, which is also visibly transparent to the viewers;
    • “Online Lottery” means a system created to permit players to purchase lottery tickets generated by the computer or online machine at the lottery terminals where the information about the sale of a ticket and the player’s choice of any particular number or combination of numbers is simultaneously registered with the central computer server;
    • “Organising State” means the State Government which conducts the lottery either· in its own territory or sells its tickets in the territory of any other State;
    • “Prize”meansthe amountpayableagainstawinningnumberticket;
    • “Sale Proceeds” means the amount payable by the distributor to the Organising State in respect of sale of tickets calculated at the face value printed on .each ticket in respect of lotteries of a particular draw or scheme or both;
    • “Security Deposit” means a deposit or amount or bank guarantee paid to the Organising State by the distributor or selling agent in any form for due fulfillment of the contract.
  • Words and expressions used but not defined herein but defined in the Act shall have the meanings respectively assigned to them in the Act.

3.     Organisation of Lottery.

  • A State Government may organise a paper lottery or online lottery or both subject to the conditions specified in the Act and these rules.
  • The State Government may organise a lottery or lotteries, if it so decides, by issuing a notification in its Official Gazette, outlining the purpose, scope, limitation and methods thereof. (Outlined in the ANNEXURE)
  • TheOrganisingStateshallannounceinadvance,bywayofanotificationintheOfficial Gazette, the following information about every lottery, namely:-
    • thename ofthe lotteryor lotteryscheme;
    • prices of thelotteryticket;
    • totalnumberofticketsprintedincaseofpaperlottery;
    • grossvalueofthetickets printed;
    • nameornamesofthedistributorsorsellingagentswiththeiraddressesandcontact information;
    • prizestructure;
    • theamountoffered asprizemoney;
    • periodicityofthe draw;
    • theplacewherethedraw shall beconducted; and,
    • theprocedurefordrawingtheprizewinningtickets orprize-
  • IncaseanOrganisingStatedecidestoorganisemorethanonelottery,theprocedureas provided in sub-rule(3) shall be followed for each lottery.
  • Thepaper lottery tickets and the stationery on which the online lottery tickets are issued shall be printed by the Organising State at a Government Press or any other high security press included in the panel of the Reserve Bank of India or the Indian Banks’ Association,
  • Thenumber of lottery draws except bumper draw by an Organising State from all the lottery schemes put together, shall not be more than twenty four per day.

  • The Organising State shall charge a minimum amount of five lakh rupees per draw for bumper draw of lottery and, for all other forms of lottery, a minimum amount of ten thousand rupees per draw.
  • The State Government under whose jurisdiction the lottery tickets are being sold shall be entitled to charge a minimum amount of two thousand rupees per draw from the Organising State but the maximum amount chargeable shall not be more than what is being charged by the State Government from its own lotteries.
  • The Organising State shall publish the result of the draws in at least one national and two state level newspapers out of which one shall be in English as well as in its Official Gazette.
  • The Organising State shall designate an officer, not below the rank of Secretary to the Government of the State, as the designated authority, who shall be responsible fororganising the lottery in the State.
  • An Organising State shall not offer a prize on a lottery ticket or in an online lottery on the ‘basis of single, double or triple digit in any form or combination.
  • In cases where an Organising State appoints or authorizes distributors or selling agents, it shall be the responsibility of the Organising State to ensure that the said distributors or selling agents act in conformity with the provisions of the Act and these rules.
  • The Organising State shall keep records of the tickets printed, tickets issued for sale, tickets sold,ticketswhichremainunsoldatthetimeofthedraw, andtheprizewinningtickets along with the amount of prize or prizes in respect of each draw, in the manner prescribed by the Organising State.
  • The Organising State shall ensure that proceeds of the sale of lottery’ tickets, as received fromthedistributorsorsellingagentsoranyother source,aredepositedinthePublicLedger Account or in the Consolidated Fund of the Organising State.
  • It shall be the responsibility of the Organising State to ensure that income tax on prizes, wherever applicable, is deducted at source and that, the prize money is credited to the bank account(s) of the prize winner(s).
  • Every Organising State shall conduct an annual financial and systems audit of the various lottery schemes organised by it including online lottery.
  • The Central Government may also conduct a special audit of any lottery or lottery scheme organised by any Organising State through the Comptroller and Auditor General of India or any other agency appointed by the Central Government for the purpose and take suitable action thereon.
  • The Organising State shall device suitable means and procedures to effectivelysupervise the conduct of the lottery including the process of draws and all steps till publication of resultsto avoid any malpractices.
  • Every State Government shall ensure that no lottery, in any form, is organised by any authorityotherthan theOrganisingStateoritsappointeddistributorsorsellingagentswithin its jurisdiction.

2.      Appointment of distributor or selling agent.

  • The Organising State may specify qualifications, experience and other terms and conditions for the appointment of distributors or selling agents. (Specified in the ANNEXURE)
  • The distributors or selling agents shall furnish a securitydeposit or a bank guarantee, as may be specified by the Organising State. (Specified in the ANNEXURE)
  • The, distributors or selling agents shall maintain a record of the tickets obtained from the OrganisingState, tickets sold and thosewhich remain unsold up tothedateand timeofdraw along with other details, as may be specified by the Organising State.
  • The Organising State shall pay to the distributors or selling agents any commission due to them and the prize amounts disbursed by the distributors of selling agents to the winners, if any, out of the money so deposited in the Public Ledger Account or in the ConsolidatedFund of the Organising State.
  • The distributors or selling agents shall return the unsold tickets to the Organising State with full accounts along with the challans of the money deposited in the Public Ledger Accountor in the Consolidated Fund of the Organising State through the sale of tickets.
  • The unsold tickets and unused counterfoils of lottery tickets shall be disposed off in the manner specified by the Organising State from time to time. (Specified in the ANNEXURE)

1.      Procedure to prohibitthe sale of lottery tickets by the Central Government.

  • If a State Government is of the opinion that the Organising State or their distributors or selling agents are organising lotteries in violation of the provisions of the Act and theserules, it shall immediately bring the violations to the notice of the Organising State concerned alongwith the details of such violations or irregularities noticed and the Central Government shall also be apprised of such violations or irregularities simultaneously.
  • The Organising State shall send a suitable response on the issues raised by the State, Government under sub-rule (1), within a period of thirty days of the receipt of such
  • IncasewheretheStateGovernment concerned is not satisfied withtheresponsesent bythe Organising State under sub-rule (2) or the Organising State, does not respond or does not take action to discontinue the organization of the said lottery scheme, the State Government concerned, under whose jurisdiction, the lottery tickets, are being sold, may bring to the notice of the CentralGovernment all relevant details of violations or irregularities and the communications made with the Organising State, along with itsrecommendations on the action to be taken including banning of such lottery scheme of the Organising State in the geographical limits of its State.
  • TheCentralGovernmentshall,aftergivingreasonableopportunitytotheOrganisingStateof being heard either, in writing or in person, take the final decision whether action is required to be taken against the lottery scheme of the Organising State under section 6 of the Act.
  • In case the Central Government decides to prohibit any such lottery scheme, it shall issue an order under section 6 of the Act prohibiting such lottery and direct the State Government concerned to give wide publicitythrough daily newspapers or electronic media or both about the decision of the Cabinet Government.
  1. InthisAnnexure , unlessthecontex to the rwiserequires;
    • State Government’means the Government of
    • ‘Agreement’means an agreement executed between the State Government and the Distributor for marketing and selling of Nagaland State lottery tickets or the Printers for printing of Nagaland State Paper lottery tickets as the case may be.
    • ‘Director’ means the Director of Nagaland State Lotteries under whose supervision the Nagaland State Lotteries shall be conducted.
    • ‘Draw Judges’ means any Gazetted Officer of the State Government/ Central Government or Union Territories and Executive Body/Member of the Government registered NGO who may be appointed by the Director, Nagaland State Lotteries.
  • ‘Paper Lottery’ means a ticket printed having digital numbering on top right and bottom left in every tickets and players makes their choice of a particular ticket number which are soldin the lottery market by the various sub-agents/ sellers appointed by the Distributor.
  • ‘Printer’ means a person with whom an agreement shall be executed for printing of lottery
  • ‘PrizeSecurity’meansasecuritygivenbytheDistributorinfavour of theDirectortoensure payment of prizes to the prize winners.
  • ‘Ticket’ means the Nagaland State lotteries (both paper and online) tickets printed and released by the Director to the Distributor for sale in market to be played by the customers through various terminals after registration in the central computer system. The ticket is the only document a player may use to claim any prize amount.
  • ‘State Lottery’ means the lotteries organized, conducted or promoted by the State
  1. Purposeand scope : Refer Rule 3(2): The main purpose and scope of organizing the NagalandStateLotteriesis toearnadditionalrevenueof theStatefordevelopmentalactivities.
  2. Methods and limitations: Refer Rule 3(2): Methods and limitations for conduct of Nagaland State Lotteries are elaborated as under:-
    • The State Lottery shall be organised, conducted or promoted by the State Government through variousterminals connectedwith the CentralServer,orshallauthorize the Distributor for sale of tickets after entering into written agreement.
    • A Mirror Server shall be monitored in the Directorate of Nagaland State Lotteries by the Director or his authorized officer.
    • The State Lottery shall be named as the “Nagaland State Lotteries” with such other sub- names as may be decided by the Government/ Director from time to time as per market
    • The Director shall arrange to deliver the tickets on behalf of the State Government to the Distributor as the case may be at the place mutually agreed upon.
    • The form, size and design of tickets shall be decided by the Director on behalf of the State
    • The printed tickets for a particular draw shall bear the imprint and logo of the State Government, distinctive number, the date/ time of draw and the sale price of the ticket/ minimum retail price (MRP) and facsimile signature of Director, Nagaland State Lotteries. On the reversed side of the tickets, there shall be a printed information in English/ Hindi or any Regionallanguageshowing prize structure andsuch other essentialdetails and conditions as the State Government may consider necessary for the purchasers. Such terms andconditions which appear on the Lottery tickets shall be determined by the State Government through the Director.
  • The printing of the Online lottery ticket, as per the approved schemes, shall be done by the Terminal(s)/ Retailers and shall have the imprint logo and facsimile signature of the Director. Such tickets shall be sold after printing of the players’ selected numbers.
  • The schemes are liable to be changed or modified by the Government keeping in view/ according to market conditions.
  • No instrument of any kind used in transmission of alpha-numeric message or any instrument of audio visual display/recording shall be allowed to the person(s) present at the draw place.
  • A certified copy of the results shall be supplied to the representative of the Distributor by the authorized officer(s) of the Government/ Director after the last draw conducted during the
  • The State Government may authorize the Distributor to make the payment of prizes on its behalf, uptothe value of Rs.5,000/- (Rupeesfive thousand) onlyto the prize winners within a period of 90 (ninety) days from the date of announcement of the result. The expenses incurred by the Distributor on account of payment of such prizes may be adjusted /set-off against the sale proceeds of lottery tickets payable by the Distributor to the State

Payment of prizes which is not covered under the above provision will be made by the Director after deduction of Tax Deduction at Source (TDS) and Departmental charges, if any.

  • One ticket will enable the holder thereof to claim one prize only, whichever is higher. Theprize winner for amount above Rs.5,000/- shall be required to submit the Prize Winning Tickets(PWT)inoriginalalong with3(three) copiesof passport sizephotographsupportedby documentary proof and a Court Affidavit duly attested and signed by the 1st Class Magistrate addressed to the Director, Nagaland State Lotteries, Kohima for payment.
  • Prizes that are not claimed by the Prize winners within a period of 90 (ninety) days from the date of publication of result shall not be disbursed and shall stand forfeited to the State Government as unclaimed prize money.

Provided that the Director may, in exceptional circumstances, disburse the prize amount to the prize winners on his/ her application even after the expiry of the said period of 90 (ninety) days but not exceeding 120 (one hundred and twenty) days if he is satisfied that the reasons for not claiming the prize amount within the said period of (90) (ninety) days are cogent and genuine.

In order to determine the unclaimed or undistributed prize money, the Distributor shall, within a period of one month from the expiry of the period of 90 (ninety) days referred to above, submit the audited account thereof, to the Director, Nagaland State Lotteries.

  • Noforged,torn,mutilatedortamperedticketshallbeentertainedforprizeclaim
  • The prize claims on taxable amount shall be paid after due verification of prize winning ticket (PWT) from the concerned printing press or central server/ mirror server.
  • TheentireprizeranksshallbepaidonlyinIndian
  • There shall be 2 (two) judges for conduct of Nagaland State Lotteries with a time table shift- wise in the day to day operation of the lottery draws. They shall be appointed by the Director. He/she should be at least Class-II Gazetted officer of State/ Central Government or U.T. or a memberfromtheexecutivebodyof anyGovernment registeredNGO.Thepanelof judges so appointed shall be paid a lump sum remuneration as may be decided by the Director from time to time.
  • The Distributor shall lift the lottery tickets within such reasonable period so as to ensure the conduct of first draw within a period of thirty days from the date of execution of agreement or any other date fixed by the State Government in public interest. If the first draw is not held within the stipulated period due to the failure of the Distributor in lifting the tickets, then his performance security/ Bank Guarantee shall be forfeited to the Government.
  • The Distributor shall lift all the printed lottery tickets at a wholesale/ discounted price to be mutually agreed and decided upon by the Director and the Distributor, keeping in view the market condition, in such advance period as may be laid down in the agreement. TheDirector may also allow the Distributor to lift the tickets of each lottery on credit against an unconditional Bank Guarantee or cash security kept in the shape of Fixed Deposit Receipt.

In case the Distributor fails to lift the tickets already printed in full or in part, he shall be required to pay damages equal to the amount of the invoice value of the un-lifted tickets.

  • Any defect or deficiency noticed in the printed tickets should be immediately brought to the notice of the Director. Under no circumstances such defective ticket should be sold. The purchaser(s) or Distributor, as the case may be, may get rectified tickets in exchange for the defective tickets without extra payment. The exchange will be done by the Government/ Distributor immediately on production of the defective/mutilated tickets by the Distributor/ purchaser, as the case may be.
  • In case of loss of tickets in transit, the same shall immediately be brought to the notice of the Director for publication in the newspapers. However, in case of loss of tickets after deliveryto the Distributor, no compensation of any kind shall be payable to the Distributor.
  • The Distributor shall lift the printed tickets in full or in part by raising invoice and the delivery challans by the Government.
  • The Distributor desiring to stop the marketing of tickets at his own will shall be required togive prior notice of 30 (thirty) days to the Government failing which the Distributor shall have to compensate the State Government for the revenue that it would have otherwiseearned during the period of 30 (thirty) days. In addition to the compensation amount describedabove, the State Government may also recover such damages as per the terms of the
  • In the event of any loss or damage caused to the State Government due to the omission or negligence of the Distributor, Printers or Advertising Agencies, as the case maybe, the same shall be made good (including damages, if any sustained by the State Government, as perthe provisions of the Agreement) by the said Distributor or Printer or Advertising Agency.
  • The State Government/ Director may appoint a locally based renowned firm/company of Chartered Accountants and technical experts for the purpose of conducting annual financial and system audit.
  • In case of any dispute, the State Government shall be the Sole Arbitrator and its decision shall be final and binding.
  • For anyquestionarising out of these Rules, or anyother matter concerning thereof, thesame shall be referred to the State Government and the decision of the State Government thereon shall be final.
  • ThecourtofcompetentjurisdictionoftheseRulesshallbethecourtatKohima,
  • The record relating to those draws which are no longer required, shall be kept in the custody of the Director for a maximum period of three years from the date of publication of the result, after which it shall be destroyed with the approval of the State Government and the decision in this regard will be communicated to the Accountant General, Nagaland and the Director, Treasuries & Accounts, Nagaland as well as to the Administrative Department one month before the date of such destruction.
  • Consequent upon implementation of these Rules , the following rules are here by repealed :-
    1. The Nagaland State Lottery Rules1972;
    2. Nagaland State Online Lottery Guidelines,2002;
    3. Nagaland State Online Lotteries (Regulation)Rules,2003;and
    4. Nagaland State Lotteries (combined) Rules

Notwithstanding such repeal anything done or any action taken under the Rules so repealed shall be deemed to have been done or taken under the provision of Lotteries (Regulation) Rules, 2010.

A.  Appointment of Distributor : Refer Rule 4 (1) & (2)

The State Government shall appoint a person/ firm/ company having legal entity with sufficient experience in lottery business as Distributor for marketing and sale of the State Lottery ticketsfor paper and online through open tender system or on the recommendation of the selection committee with an agreement, subject to fulfillment of the following:-

  • Should be an Indian Company incorporated or registered under the Companies Act,1956 (Central Act,1956);
  • Neither the company nor any of its Directors should have been declared insolvent in the last seven years from the date of application;
  • The company as well as any of the Directors of the company should not have been sentenced by any of the court of competent jurisdiction for any offence or imprisonment during the preceding seven years;
  • Should not have been blacklisted by any Government in or outside India or defaulter in payment of Income Tax or other taxes applicable, etc.;
  • A separate agreement shall be executed between the State Government and the Distributor with specified terms and conditions;
  • Should be able to install a server in the office of the Director before the actual commencement of lotteries, where all the related information are stored and accessible by the Director/ authorized officer for direct supervision/ print-out.
  • Should be able to furnish a security deposit in the form of unconditional Bank Guarantee or bond given by a nationalized bank having its branch at Kohima, Nagaland in favour of the Director, Nagaland State Lotteries which can be forfeited by the Government on violation /breach in terms of the agreement.
  • Should submit a Memorandum/ Articles of Association at the time of application for

B.  Publication of result : Refer Rule 3(12):

The Director shall ensure publication of results of lottery draws in the prescribed newspapers on daily basis. The cost of publication shall be borne by the respective Distributors. The expenses incurred by the Distributor on account of such payment made totheDirector/Government shallnot berefundableor adjustablefrom thesaleproceedspayable to the State Government.

C.   Unsold tickets and unused counter foils : Refer Rule4(6)

After due verification by the officials of the Government, the unsold tickets/ counterfoils shall be destroyed by the Government once every other year in the presence of the representative(s) of Distributor as the case may be decided by the State Government fromtime to time.

Acts and Rules Administered by the Directorate:

The West Bengal State Lottery is organized, conducted and promoted in terms of the provisions of

  • The Lotteries (Regulation) Act, 1998.
  • The Lotteries (regulation) Rules, 2010.
  • The West Bengal Lotteries (Regulation on Payment of Charges for Draw) Rules, 2011.

 

Nature of Work/Responsibilities:

The Government of West Bengal conducts and organizes State Lotteries through the Directorate as per provisions made in different Acts, Rules and notifications. Draws are held in public under the supervision of two independent judges. The rank and file may come and see the draws on the spot. Since, the venue is fixed and is declared well ahead of each draw, any person present in the draw may examine and inspect the procedure to mitigate his doubt, if any. The live telecast of draws is going on through Youtube. An extraordinary transparency is maintained throughout the process of each lottery draw starting from the Government notification and printing of tickets in the Government Security Press to the publishing of results in leading dailies. Thus, for decade the West Bengal State Lottery has become distinct, credible and faithful over other forms of lottery.

Since the recent past, revenue earnings from lottery have been steady increasing due to good governance and a professional approach by the Directorate. The pragmatic approach adopted by this Directorate from time to time and consequent business strategy being pursued, have increased the possibility of revenue earning and employment generation in a bigger way throughout the State.

Policy/Circulars:

In the year 2018-19, this Directorate has introduced seven weekly draws with effect from 14.05.2018. Six Bumper Draws in festivals viz. New year Bumper, Holi Bumper, Nababarsha Bumper, Rathayatra Bumper, Puja Bumper, Diwali Bumper are also conducted.

The marketing policy of this Directorate was to increase the revenue by capturing thesizable percentage of the existing market through aggressive marketing policy involving Distributors, Stockists, Agents, Sellers etc. and also by making the schemes attractive to the sellers.

Current Policy :

During previous year West Bengal State Lottery used to accumulate an amount of revenue to the tune of 17,81,90,823/- (Rupees Seventeen crore eighty one lakh ninety thousand eight hundred twenty three) only . But with the introduction of GST on lottery West Bengal State Lottery has come out with more aggressive strategy for capturing more market share.This will enable to earn a non tax revenue around 200,00,00,000/-( Rupees Two hundred crores ) only in addition of States share of GST to the tune of ₹.2000,00,00,000/- (Rupees Two thousand crore) only in a year. The sale of lottery tickets to West Bengal lottery stockists syndicate private Limited is now on actual sale basis. The agreement with West Bengal Lottery stockist Syndicate Pvt. Ltd. is also modified accordingly. This is in order to attract the actual sellers towards selling tickets of West Bengal State Lottery and to introduce a business like atmosphere so as to increase the market share in future. To make the draw procedure more transparent, the live telecasting of draw is going on through Facebook and Youtube.

Status of Computerisation:

As it is planned to market 3 crores of lottery tickets through a sole-distributor, the West Bengal State Lottery requires handling a large volume of data on daily basis. In order to manage the sales, speedy disposal of claims as well as accounting with such huge volume, the Directorate of State Lotteries has taken up a project to develop a user friendly customized on line based software as well as website with the help of NIC. On successful completion and security certification, this is going to be launched very shortly.

Apart from this, the Directorate is successfully using IFMS & HRMS and has a plan to introduce e-office very shortly also.

Maintenance of Accounts & Audit:

Books of accounts are maintained properly. Salary accounts of the Directorate are computerized by the HRMS, Software developed by TCS. All reports and returns for Income Tax are submitted regularly within the stipulated time. The Directorate has deducted Income Tax to the tune of 15,75,06,846/- (Rupees Fifteen crore seventy five lakh six thousand eight hundred forty six) only during 2018-19 and remitted the same to the Income Tax authorities. At the same time administrative charges amounting to 174,25,000/- and charges on lottery draws amounting to 170000000/- have been deposited into the Government account during the Financial year 2018-19.

The Audit of the Accounts of this Directorate was performed by Finance (Internal Audit) Department up to F.Y. 2012-2013 and by A.G.W.B. up to F.Y. 2017-2018. in respect of both receipt and expenditure side of this Directorate.

Public Services

The earnings of State Lotteries are credited into Public Account of the State u/s 4(d) of the Lottery (Regulation) Act 1998. This revenue is mobilized for resources for developmental schemes of the State.State Lottery is also a source of business of Small Agents who can practically do the business with small capital. West Bengal State Lottery viewed in this context has some socio-economic usefulness.

Policies

Current policy of the Government is to organize, conduct and promote State Lotteries fulfilling the provisions of the Lotteries (Regulation) Act, 1998 and the West Bengal State Lottery Rules, 1968. At present four Weekly Draws viz., Bangabhumi Super Draw, Bangasree Super Draw, Bangalakshmi Draw (twice in a month) are organized in a month. Apart from these Weekly draws, six bumper draws in festivals viz., New Year Bumper, Nababarsha Bumper, Holi Bumper, Rathayatra Bumper, Puja Bumper and Diwali Bumper are conducted. The price (MRP) of the Bi- Weekly draw of Lottery ticket is Rs.2/- for Bangalakshmi draw, Rs.5/- for Bangabhumi Super draw and Rs.10/- for Bangasree Super draw. The price of tickets of Bumper Draws is usually Rs.20/-. The basic policy of the Govt. is to assure fixed prizes, which are guaranteed by declaring prizes on sold tickets only, a feature that has made West Bengal State Lottery more transparent, credible and over other lotteries.

Available Infrastructures

Since inception, State Lottery is stationed at a rented house in the 1st floor of 69, Ganesh Chandra Avenue, Kolkata – 700 013. However, there is a case pending in the Court of Law over the rent matter.The space available for officers, staff, office machines, records etc., are wholly inadequate.

Major initiatives

This Directorate has taken initiative to computerize lottery accounting system for speedy settlement of claims. This may help to stretch the lottery market within the state and in the states where lottery is permissible. In this regard, a proposal for computerization of this Directorate has already been sent to the Finance Department, West Bengal few months back.

Taxes Applicable

Income Tax and Administrative charges are applicable in respect of Fixed Prizes & Bonus i.e., above Rupees 5000/- in each case. Deduction of I. T. are made as per rates fixed by the Central Govt. as per I. T. Act 1961, and in respect of Administrative charges, deductions of Administrative charges are made on fixed prize above Rs. 5000/- in each case as per rate fixed by the State Govt. Previously Sale Tax was also charged on this Directorate on the sale of lottery tickets up to 27.04.06. At present Sale Tax on the Sale of Lottery Tickets is not applicable w.e.f. 28.4.06 as per Judgment passed by the Honorable Supreme Court of India.

Training Facilities

At present no formal / Regular training facilities are available for the staff of this directorate .

Relevant Acts

The West Bengal State lottery is organized, conducted and promoted in terms of the provisions of the lottery (Regulation) Act 1998, a Central Act and the West Bengal State Lottery Rules, 1968.

At present the only Marketing Agency which markets entire lottery Ticket of different draws of this West Bengal State Lottery Directorate is the W.B.L.S.S. Pvt.Ltd

Other Issues

This Directorate has proposed amendment(s) in the Lottery (Regulation) Act 1998, to empower the Director of State Lotteries to exercise control over the unethical Lotteries held in the State.

Forms

The following forms are used for running the day to day work in the office of this Directorate.

5. By Transfer Bill forms as per WB Treasury Rules ‘2005’- used for adjustment of claims of Variable prize money against issue of new tickets of subsequent draws.

3. For Deposit of Sales Tax on sale of lottery tickets, specific form used. At present the Directorate of State Lotteries as per order of Hon’ble Supreme Court pays no sales tax on sale of lottery tickets.

4. Separate forms are being used for depositing Administrative charges and Income Tax as deducted by this Directorate from prize winning amount into Govt A/c (under proper Head) through RBI.

5. (a) Form 16 – for depositing TDS in connection with the employees of this Directorate.

(b) Form 16A – for depositing TDS in connection with the prize winners of different draws & various payments for the third party.

INSTRUCTIONS FOR CLAIM OF PRIZE MONEY

  1. All claims of Taxable Prizes should be submitted to The Director, Nagaland State Lotteries/ Nodal Officer in the prescribed form.
  2. Separate Claim forms along with all the documents as mentioned below shall be submitted for each ticket.
  3. Any claim of Non Taxable prize money submitted to the Distributor vide this claim form or its distribution network (Including Sub Distributor, Area Distributor, Stockists, Sub Stockists, Agents & Retailers) should be forwarded to the office of the Nodal Officer / The Director of Nagaland State Lotteries.
  4. The form should be filled clearly showing the Name of the claimant, Postal Address, Name of the Lottery, Rank of Prize, Prize Amount, PAN Card, Aadhaar Card, Contact Number and Bank details like Bank Account Number, IFSC code, Name of the Bank and Branch, cancelled cheque etc. and the number of claims in the Current Financial Year.
  5. Original prize winning ticket with one photocopy duly attested by a Gazetted Officer / Notary Public, along with four passport size photographs of the claimant, an affidavit of ownership of the prize winning ticket from any 1stClass Magistrate/Notary Public should also be submitted.
  6. Government of Nagaland shall not be liable to pay prizes on tickets lost in postal transit, defaced/laminated or mutilated.
  7. Tampered tickets shall not be entitled to get any prize and any person claiming prize money with a tampered ticket is liable to be sued in a court of law. Any such claimant shall be liable to appear before the Director, Nagaland State Lotteries or the Appropriate Authority as and when called for.
  8. The Director shall disburse Prize Money for accepted genuine claims after making necessary deduction of Income Tax etc.
  9. Prize money in favour of winners outside Nagaland shall be paid in the form of Demand Draft / RTGS / Cheque after deducting commission, on drafts and postal charges as applicable.
  10. Prize money payable to winners within Nagaland shall be paid in the form of cheque / pay order / RTGS.
  11. The Directorate of State Lotteries may publish the details of the Prize Winners which may include the name, address and photo of the winner of a prize amount above ₹10,000/- in the newspapers, magazines, television, radio, social media, online websites, outdoor media etc. The winner who is submitting the original ticket may accept and fill the claim form accepting the terms and conditions as stipulated therein.
  12. Any winner claiming a Prize Amount above ₹ 10,000/- (Taxable Prize Money) more than once, in a particular Financial Year, shall provide the details of Purchase of such tickets which shall include the Name of the State in which tickets were purchased, Name of the Seller from whom tickets were purchased along with his mobile number for verification, or any additional details which may be required before the disbursement of prizes.
  13. Claim form along with original prize winning ticket/s shall be submitted within 30 days from the date of draw or announcement of result.

An Act to regulate the lotteries and to provide for matters connected therewith and incidental
thereto.
BE it enacted by Parliament in the Forty-ninth Year of the Republic of India as
follows:-
1. (1) This Act may be called the Lotteries (Regulation) Act, 1998. Short title, ex-
tent and com-

2. In this Act, unless there is anything repugnant in the subject or context- Definitions
(a) “bumper draw of a lottery” means a special draw of lottery conducted on or
during any festival or other special occasion wherein the prize money offered is greater than
the prize money offered in the case of other ordinary draw of lotteries;

(b) “lottery” means a scheme, in whatever form and by whatever name called, for
distribution of prizes by lot or chance to those persons participating in the chances of a prize by
purchasing tickets;
(c) “prescribed” means prescribed by rules made under this Act.
Prohibition of 3. Save as otherwise provided in section 4, no State Government shall organize, conduct or

Government or not otherwise distributed, shall become the property of that Government;
(g) the place of draw shall be located within the State concerned;
(h) no lottery shall have more than one draw in a week;
(i) the draws of all kinds of lotteries shall be conducted between such period of the
day as may be prescribed by the State Government;
(j) the number of bumber draws of a lottery shall not be more than six in a calendar
year;
(k) such other conditions as may be prescribed by the Central Government.

6. The Central Government may, by order published in the Official Gazette, Prohibition of

7. (1) Where a lottery is organized, conducted or promoted after the date on which this Penalty
Act receives the assent of the President, in contravention of the provisions of this Act, by any
Department of the State Government, the Head of the Department shall be punishable with
rigorous imprisonment for a term which may extend to two years or with fine or with both.
Provided that nothing contained in this section shall render such Head of the Department
liable to any punishment if he proves that the contravention was committed without his knowledge
or that he exercised all due diligence to prevent the commission of such contravention.
(2) Notwithstanding anything contained in sub-section (1), where a contravention under
this Act has been committed by a Department of Government and it is proved that the
contravention has been committed with the consent or connivance of, or is attributable to any
neglect on the part of, any officer, other than the Head of the Department, such officer shall also be
deemed to be guilty of that contravention and shall be liable to be proceeded against and punished
accordingly.
(3) If any person acts as an agent or promoter or trader in any lottery organized, conducted
or promoted in contravention of the provisions of this Act or sells, distributes or purchases the
ticket of such lottery, he shall be punishable with rigorous imprisonment for a term which may
extend to two years or with fine or with both.
8. The offence under this Act shall be cognizable and non-bailable. Offences to be

9. (1) Where an offence under this Act has been committed by a company, every person non-bailable
who at the time the offence was committed was incharge of, and was responsible to, the company offences by

guilty of the offence and shall be liable to be proceeded against and punished accordingly;
Provided that nothing contained in this sub-section shall render any such person liable to
any punishment if he proves that the offence was committed without his knowledge or that he had
exercised all due diligence to prevent the commission of such offence.
(2) Notwithstanding anything contained in sub-section (1), where an offence under this
Act has been committed by a company and it is proved that the offence has been committed with
the consent or connivance of, or is attributable, to, any neglect on the part of, any director,
manager, secretary or other officer of the company, such director, manager, secretary or other
officer shall also be deemed to be guilty of the offence and shall be liable to be proceeded against
and punished accordingly.

Explanation – For the purposes of this section –
(a) “company” means any body corporate and includes a firm or other association of
individuals; and
(b) “director”, in relation to a firm, means a partner in the firm.

rules. (2) Every rule made by the Central Government shall be laid, as soon as may be after it is
made, before each House of Parliament, while it is in session, for a total period of thirty days
which may be comprised in one session or in two or more successive sessions, and if, before the
expiry of the session immediately following the session or the successive sessions aforesaid, both
Houses agree in making any modification in the rule, or both Houses agree that the rule should not
be made, the rule shall thereafter have effect only in such modified form or be of no effect, as the
case may be; so, however, that any such modification or annulment shall be without prejudice to
the validity of anything previously done under that rule.
Power of State 12. (1) The State Government may, by notification in the Official Gazette, make rules to
Government to carry out the provisions of this Act.

(2) In particular, and without prejudice to the generality of the foregoing power, such rules
may provide for all or any of the following matters, namely:-
(a) time to be fixed for claiming prize money under clause (f) of section 4;
(b) period to be fixed for draws of all lotteries under clause (i) of section 4; and
(c) any other matter with is required to be; or may be, prescribed.
(3) Every rule made by the State Government under this section shall be laid, as soon as
may be after it is made, before each House of the State Legialature where it consists of two
Houses, or where such Legislature consists of one House, before that House.
Repeal and 13. (1) The Lotteries (Regulation) Ordiance, 1998, is hereby repealed. Ord. 6 of
saving 1998
(2) Notwithstanding such repeal, anything done or any action taken under the said
Ordinance, shall be deemed to have been done or taken under the corresponding provisions of this
Act.
